Scope

These General Terms and Conditions apply to all contracts concluded between [Name of the online shop] (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Customer”) via the Seller’s online shop. The online shop is exclusively directed at consumers within the meaning of § 13 of the German Civil Code (BGB), i.e., natural persons who order goods or services from the online shop for purposes that are predominantly not attributable to their commercial or independent professional activity.

The Seller’s online shop offers products for the cultivation of mushrooms. These include mushroom cultures, mushroom substrates, and accessories that enable the Customer to cultivate mushrooms in their own premises. These terms and conditions apply to all orders placed by the Customer through the Seller’s online shop, regardless of whether the Customer acquires the products for personal use or for resale. Deviating conditions of the Customer are not recognized unless the Seller has expressly agreed to them in writing.

The scope extends to all offers and services of the Seller that can be purchased through the Seller’s online shop. These terms and conditions apply in the version valid at the time of the conclusion of the contract. The Seller reserves the right to change these terms and conditions at any time and without stating reasons. The original terms and conditions apply to contracts concluded before the change in the terms and conditions.

  1. Contracting Parties

These General Terms and Conditions regulate the contractual relationship between [Name of the online shop] (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Customer”).

Customer:

The customer is any natural person who enters into a business relationship with the Seller and acquires the goods or services of the Seller.

Contact options:

The Customer can contact the Seller by email or phone. The Seller’s contact details can be found on the website of the online shop. The Seller will endeavor to respond to Customer inquiries as quickly as possible.

The contractual relationship between the Seller and the Customer is established through the Customer’s order and acceptance by the Seller. The Seller reserves the right to reject Customer orders without stating reasons. The Seller will promptly inform the Customer of the rejection of their order.

The Seller reserves the right to change the offered goods or services as well as prices at any time and without stating reasons. Changes will be published on the website of the online shop. The Seller will strive to inform the Customer about changes to goods or services as well as prices as early as possible.

  1. Conclusion of Contract
  2. a) Order

The Customer submits a binding offer to purchase the selected goods by going through the order process in the Seller’s online shop and clicking the “Buy” button or a similar button. Before submitting the order, the Customer can review and, if necessary, correct all information. The Seller confirms the receipt of the order immediately by email.

  1. b) Conclusion of Contract

The contract between the Customer and the Seller is only concluded when the Seller ships the goods to the Customer.

  1. Right of Withdrawal

As a consumer, the Customer has the right to withdraw their declaration of contract within 14 days without giving any reason. The withdrawal period begins on the day the Customer or a third party named by them takes possession of the goods.

To exercise the right of withdrawal, the Customer must notify the Seller of their decision to withdraw from the contract by means of a clear statement (e.g., by post or email). The Customer can use the model withdrawal form provided below, but the use of the model withdrawal form is not mandatory.

In the event of withdrawal, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a different delivery method than the standard delivery offered by us), within 14 days of receiving your withdrawal notice. The refund will be made using the same payment method you used for the original transaction, unless expressly agreed otherwise. You will not incur any fees for the refund.

In the event of exercising your right of withdrawal, you are obliged to return or hand over the goods to us immediately and in any case no later than 14 days from the day on which you informed us of the withdrawal from this contract. The deadline is met if you send the goods before the expiration of the 14-day period. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the condition, properties, and functionality of the goods.

  1. Delivery Conditions

We strive to process and ship your orders as quickly as possible. All orders will be processed and shipped within 3-5 working days of receiving your order, provided the items are in stock. For items not in stock, an estimated delivery time will be communicated to you.

In the case of a sale by shipment, the risk of accidental loss or deterioration of the goods passes to you upon delivery to the transport company if your place of residence is in Austria (this does not apply to customers outside Austria).

Our items are shipped via reliable shipping service providers to ensure that your order arrives safely and quickly. The exact shipping costs will be displayed during the ordering process and depend on the weight and size of your order, as well as the shipping method.

Please note that we cannot be held liable for delays in delivery caused by circumstances beyond our control, such as inclement weather, strikes, or delays by the shipping service provider.

If your order arrives damaged or faulty, please contact us within 48 hours of receiving the goods so that we can resolve the issue as quickly as possible.

Our shipping is standardly within Austria and to Germany only. For deliveries to other countries, please contact us before ordering to discuss shipping costs and delivery times.

  1. Prices and Payment Conditions

The prices quoted include the statutory value-added tax at the time of ordering, plus all shipping costs. The exact prices will be displayed in the shopping cart before the conclusion of the contract and are also visible in the order confirmation sent to the Customer. If export or import duties arise during shipping, these are to be borne by the Customer, and further information can be obtained from the relevant customs office.

For sales to customers outside the European Union, no value-added tax is charged, but national import duties may apply, which are to
